Daniel M. Benjamin
Mr. Benjamin’s practice focuses on commercial and complex civil litigation, and he has represented numerous corporate, governmental, and individual clients. He actively litigates cases in Guam, California and the CNMI. Recent engagements include successful argument on behalf of the Governor of Guam before the Ninth Circuit Court of Appeals in an action concerning the respective powers of the Governor and Attorney General of Guam. Mr. Benjamin also recently obtained summary judgment on behalf of the Government of Guam in a putative class tax action where the plaintiffs had sought tens of millions of dollars in damages. Other recent successes include the dismissal with prejudice of an action concerning a sizeable piece of beach front real estate in Guam and dismissal of an action challenging the legality of Guam’s property tax assessment system.
Prior to joining Calvo & Clark, Mr. Benjamin served as a law clerk to the Honorable David R. Thompson of the United States Court of Appeals for the Ninth Circuit and was an associate at the San Francisco office of the law firm of Morrison & Foerster, LLP. Mr. Benjamin also served as a judicial extern to the Honorable Anthony Kline, a Presiding Justice of the California Court of Appeal. He is admitted to the territorial and State courts in Guam, California, and the Commonwealth of the Northern Mariana Islands, as well as to the bars of the U.S. Supreme Court, the Ninth Circuit Court of Appeals, the Northern District of California, the District Court of Guam, and the District Court of the Commonwealth of the Northern Mariana Islands.
Mr. Benjamin received his J.D. in 2000 from the University of California at Berkeley School of Law (Boalt Hall), where he was elected to the Order of the Coif, a member of the Moot Court Board, and the Senior Articles Editor and a Managing Editor of the Berkeley Journal of Employment and Labor Law. Mr. Benjamin received his B.A. in 1997 from the University of California at Santa Cruz with Honors.
